WHAT IS BAIL (Bail Bond)?

In short, bail bonds allow an accused person to be temporarily released from jail. HOW DOES A BAIL BOND FUNCTION?

A Court decides the bail bonds amount. The State of California allows a licensed bail bonds company to provide jail bonds that guarantees payment of the entire bail amount if the accused does not appear for Court appearances. For providing bail bonds services the licensed bail bond service providers charge a percentage of the total bail amount, usually 10%. If a bail bond amount were set at $20,000, the amount would be about $ $2,000. This jail bond is not refundable once the defendant is released.

IS A BAIL BOND AND A PREMIUM THE SAME THING?

No. The bail bond is the complete amount of the bail set by the court. The premium is the amount charged by the licensed bail bonds company for providing the pre-trial release service. WHAT IS A CO-SIGNER?

A co-signer is the person willing to be responsible for the accused while they are out on bail. They assume financial responsibility for the entire bail amount.

WHEN IS A BAIL BOND EXONERATED?

A bail bond is exonerated when the legal process is over and does not matter whether the defendant is found guilty or innocent. When the legal proceedings and trail (even a dismissal) is finished the bail bond is ended. But unpaid monies to the bail bond agent are still owed.

WHAT CONSTITUTES A BAIL BOND FORFEITURE?

Forfeiture happens when a defendant fails to make a Court date. When this happens a “bench warrant” is issued for their arrest. Many times a bail bond may be reinstated by the defendant working with Jane Un Bail Bonds to report back to the court, which allows the court to set a new trial date for the defendant.

HOW DOES A REINSTATEMENT OR SUMMARY JUGEMENT WORK?

When a defendant has their bench warrant removed the bail bond can “reinstated” with the court. The defendant, working with Jane Un Bail Bonds, will report back to the court that allows the court to set a new court date for the defendant. A summary judgment is issued if following bail bonds forfeiture the deadline for a reinstatement of the bond or the returning the defendant to custody has passed. When a summary judgment is issued the full bail amount must be paid.

WHAT DOES THE COURT CONSIDER IN SETTING THE AMONT OF THE BAIL?

Judges are not allowed to use bail bonds to punish the defendant. Bail bonds are only to be used to guarantee the appearance of the charged. Excessive bail is a violation of constitutional rights. To set bail the court takes into consideration the seriousness of the charge and the defendant’s previous criminal record.

Public safety is also considered.  Also, the judge may look at family ties to the geographic area as well as other ties, such as a job, a home, etc. to assess whether a person could be a fight risk.

These factors determine the probability that the defendant will appear at future Court dates.
